The East Brewton City Council passed an ordinance Monday that made them the third city in Escambia County to place a ban on smoking in public places.
The ordinance, much like one put into place in Flomaton, calls for a 100 percent smoke-free environment for all public facilities.
Under the ordinance, smoking is prohibited within 25 feet outside an enclosed area where smoking is prohibited; all retail stores; seating areas of all outdoor arenas, stadiums and ball parks; licensed child care and adult day care facilities; polling places; restaurants; and others as the council has outlined.
The ordinance, which will become effective on Nov. 1, also made provisions for persons and businesses that do not carry out the provisions of the new law.
A person who smokes in an area where smoking is prohibited by the provisions of the ordinance, shall be punished by a fine not exceeding $50.
For a person who owns, manages or operates a public place or place of employment and fails to comply with the provisions of the ordinance shall be punched with a fine of $100 for the first violation; $200 for a second violation within one year; and $500 for each additional violation within one year.
Brewton has also passed a no-smoking ordinance. The Escambia County communities are among the only towns in Alabama that have passed such ordinances.
In other business, the East Brewton City Council made an award resolution to Cardinal Contracting Inc. for sanitary sewer improvements within the city limits. The award was made to the company based on their low bid in the project of $417,990.
Also during the meeting, the council approved a decision to make a grant application through Cardinal Contracting for sidewalk and street improvements.
Howard said the phase would include the construction of sidewalks and decorative lighting in the area.
A second phase would follow with similar construction from Simmons Street to the intersection of Forrest Avenue and Harold Street.
