The man convicted of kidnapping, robbing and killing the owner of a Cullman grocery store will be put to death by lethal injection Oct. 8 at Holman Prison in Atmore.
Death row inmate Max Landon Payne of Cullman was convicted of murdering Braxton Brown after kidnapping him from his store, West Point Grocery, during a robbery on March 23, 1992.
Brown’s body was found the following day in Crooked Creek with a gunshot wound to the head.
Payne was arrested one day later at a bus station in Miami, Fla.
Attorney General Troy King asked the Supreme Court to set an execution date because Payne had finished his appeals.
The U.S. Supreme Court turned down Payne’s case in May and the execution date was announced last week.
The Oct. 8 execution will be the sixth this year.
Other convicted criminals, James H. Callahan and Danny J. Bradley of Calhoun County, Jimmy Lee Dill and Jack Trawick of Jefferson County and Willie McNair of Montgomery County have all been executed this year following their murder convictions.
Payne currently sits on death row at Holman Prison awaiting execution.
