An Atmore man accused of attempted kidnapping waived rights to arraignment last week in a Baldwin County Court.
Troy Aver Barton, 46, was arrested after a December 2010 incident in the Bay Minette area that found him behind bars on firearms and attempted kidnapping charges.
Barton’s attorney, James Pittman Jr., filed the waiver for arraignment last week and entered a not guilty plea on behalf of his client. Barton was previously scheduled to be arraigned last week on charges of reckless endangerment and first-degree unlawful imprisonment along with the attempted kidnapping and possession of a sawed-off shotgun charges.
A hearing was held in February with testimony in the case that resulted in the charges against Barton.
Barton allegedly went to the home of his mother-in-law in December brandishing a weapon and in possession of a pillow case, duct tap and zip ties. According to reports from police, Barton is believed to have formed a plan to restrain his in-laws to allow him to take his wife, Tammy Barton, from the home to attempt reconciliation with her. Tammy Barton was not at the residence when he arrived.
An altercation with a man believed to be Tammy Barton’s boyfriend at the time of the incident lead to the firearm being discharged. Law enforcement officers said no injuries were reported as a result of the shot fired.
Barton is being held in the Baldwin County Corrections Center on a $525,000 bond.
