Landfill public hearing set for today

A crowd is expected to attend a public hearing on the proposed Conecuh Woods landfill at 9 a.m. Thursday at Reid State Technical College in Evergreen.

Reid State officials have asked that attendees to the public hearing not park on campus. Officials said parking would be available at a nearby hotel parking lot.

Signage will direct traffic to the event, and members of Citizens for a Clean Southwest Alabama said shuttles will be taking people from parking lots to the hearing site.

The Conecuh County Commission has set some rules for the public hearing. Representatives for Conecuh Woods LLC will have 30 minutes to speak, and then others will have five minutes each.

Other rules include:

1. Persons wishing to speak at the public hearing must sign in at the registration table giving their name and residence address. Speakers will speak in the order in which they signed up.
2. Speakers must speak at the microphone and will be allowed to speak only one time. Before beginning their remarks, speakers must give their name and residence address. Speakers should speak clearly in order that their remarks may be understood by all persons present, including the stenographer recording the public hearing. Persons in the audience will not be allowed to ask questions of speakers. Speakers must address their remarks to the hearing officer.
3. Conecuh Woods LLC will make its presentation first and will be allowed 30 minutes to make its presentation. Speakers will be allowed to speak for five minutes.
4. Written comments will be received by the commission until the conclusion of the public hearing. If written comments are submitted by U.S. Mail, they must be postmarked no later than the date of the public hearing. Written comments submitted by U.S. Mail should be addressed to: Judy Covan, Conecuh County Administrator, 111 Court St., Evergreen, AL 36401. All written comments timely submitted to the commission on the application of Conecuh Woods LLC will be retained as part of the official administrative record.
5. The hearing officer will be in control of the public hearing. Comments from speakers must be germane to the application of Conecuh Woods LLC. Speakers must avoid repeating the remarks of previous speakers. Speakers will not be allowed to make personal attacks as part of their remarks. The hearing officer will eject anyone from the public hearing who, in the sole discretion of the hearing officer, engages in disruptive behavior of any kind. Speakers who fail to comply with these rules will not be allowed to continue to speak.
6. A transcript of the public hearing will be prepared and will be available for purchase by interested persons directly from the stenographer who will prepare the transcript.
7. The official administrative record relating to the application of Conecuh Woods, LLC will be assembled by the Conecuh County Commission staff and will include the Resolution of the Conecuh County Commission adopted at its regular meeting held on January 24, 2011, the Notice of Public Hearing on the application of Conecuh Woods, LLC, the proof of publication of said Notice in a newspaper of general circulation in Conecuh County, Alabama, the transcript of the Public Hearing, all timely written comments, the Conecuh County Solid Waste Management Plan, the application of Conecuh Woods, LLC and a copy of the receipt reflecting payment by the Conecuh Woods, LLC of the application fee, any recommendation from the Conecuh County Commission staff on the application of Conecuh Woods, LLC, the minutes of any meeting of the Conecuh County Commission at which a vote on the application of Conecuh Woods, LLC is taken, and any findings of fact and conclusions of law adopted by the Conecuh County Commission in connection with its vote on the application of Conecuh Woods, LLC, and any other documents or materials deemed relevant by the Conecuh County Commission. Copies of the official administrative record may be purchased from the Conecuh County Commission for the cost of copying. The Conecuh County Commission may arrange for copying through an outside copy service.
